The Terms and Conditions of Novatexx.com define the rules, rights, and responsibilities governing the use of the website by its users and the obligations of the website owner.

1.4. Company Representative – An authorized employee or agent of Novatexx who provides necessary information about this Agreement.
1.5. Courier – A representative or third-party carrier authorized by Novatexx to deliver Goods to the address specified by the Client.
1.6. General Provisions – Part of the Agreement outlining the rights and obligations of Novatexx and the Client regarding Goods, prices, payment, delivery terms, and dispute resolution.
1.7. Goods – Products listed and sold through www.novatexx.com.
1.8. Order Form – The Client’s electronic order submission detailing the selected Goods, price, terms, and delivery information.
1.9. Parties – Novatexx and the Client.
1.10. Website – www.novatexx.com.
2. Object of the Agreement
2.1. Novatexx sells Goods to the Client through the Website and ensures their delivery under the terms of this Agreement.
2.2. Clients must review and agree to the General Provisions, Privacy Policy, and Return/Warranty Policy before placing an order.
2.3. The Agreement becomes effective once the Client completes payment for the selected Goods.
3. Rights and Obligations of Novatexx
3.1. Novatexx provides pre-sale information in compliance with EU Directive 2011/83/EU and applicable U.S. regulations such as the Magnuson-Moss Warranty Act.
3.2. Novatexx ensures that Goods meet all health, safety, and quality standards mandated by the EU and U.S. regulatory bodies.
3.3. Novatexx arranges delivery of Goods through authorized Couriers to the address provided by the Client.
4. Rights and Obligations of the Client
4.1. Clients confirm legal capacity to enter agreements by placing orders.
4.2. Clients are responsible for timely payment of all purchases.
4.3. Right to Withdrawal – Clients may withdraw from this Agreement within 30 days without providing a reason. Notification must be sent to support@novatexx.com.
4.4. Goods must be returned in original packaging and condition. Clients cover the return shipping costs unless otherwise specified.
4.5. Refunds will be issued within 14 days of Goods being returned to Novatexx.
5. Prices and Payment
5.1. Prices include VAT where applicable and are listed in USD or EUR.
5.2. Free delivery is offered unless otherwise stated.
5.3. Clients outside the EU or U.S. are responsible for any customs duties or taxes applicable to their orders.
5.4. Payment is required at checkout using secure payment methods listed on the Website.
6. Delivery
6.1. Goods are shipped using methods selected at checkout.
6.2. Delivery addresses must be accurate; any changes after shipment may incur additional fees.
6.3. Delays due to force majeure or unforeseen circumstances are not the responsibility of Novatexx.
7. Validity and Termination of the Agreement
7.1. The Agreement is effective upon Client confirmation of their Order Form and payment.
7.2. Novatexx reserves the right to terminate this Agreement with 30 days’ notice in cases of fraud or false information.
8. Liability
8.1. Novatexx is not liable for improper use of Goods or failure to review the Terms and Conditions.
8.2. Clients are responsible for complying with all applicable laws during use of the Website and Goods.
9. Intellectual Property
9.1. All Website content, including trademarks, software, and databases, is the property of Novatexx.
9.2. Clients may not copy or redistribute Website content without express written permission from Novatexx.
10. Terms of Saving Payment Details
10.1. Optional Storage: Novatexx allows Clients to securely save payment details for faster future purchases. This feature is optional and requires the Client’s explicit consent.
10.2. Information Stored: Saved details may include the cardholder’s name, card number, expiration date, CVV, and billing address, securely stored by our certified payment processors compliant with PCI DSS standards.
10.3. Use and Security: Stored payment details are used solely to process authorized purchases. All information is encrypted and managed by trusted payment providers, ensuring maximum security.
10.4. Client Authorization: By saving payment details, Clients confirm they are authorized users of the payment method. Saved details can be deleted anytime by contacting support@novatexx.com.
10.5. Compliance: Novatexx complies with GDPR, CCPA, and other relevant regulations, ensuring Clients’ rights to access, modify, or delete their stored information.
10.6. Liability: Clients are responsible for safeguarding their accounts. Novatexx is not liable for unauthorized use unless due to the Company’s negligence.
11. Force Majeure
11.1. Neither Novatexx nor the Client is liable for failure to perform obligations due to events beyond their control, such as natural disasters, government actions, wars, or other unforeseen circumstances.
11.2. If a force majeure event occurs, the affected Party must notify the other Party promptly and make reasonable efforts to mitigate the impact.
12. Final Provisions
12.1. Dispute Resolution: Disputes will first be resolved through negotiation. If unresolved, disputes may be directed to appropriate consumer protection entities or online dispute resolution platforms, as applicable.
12.2. Online Dispute Resolution: Online dispute resolution is available via the https://ec.europa.eu/consumers/odr/main/ EU ODR platform or through direct contact with Novatexx at support@novatexx.com. Governing Law: This Agreement is governed by the laws of the Client’s place of residence, where applicable.
12.4. Amendments: Novatexx reserves the right to update these Terms. Continued use of the Website after updates constitutes acceptance of the revised terms.
